General terms and conditions Elkedag-BBQ

Firebug BV · Version 2026-10-08

These terms govern purchases from Elkedag-BBQ in the shop, through the webshop and by quotation, and bookings for BBQ workshops. The version communicated to and accepted by the customer before the contract was concluded applies. Later amendments do not automatically apply to existing contracts.

1 Who we are

Elkedag-BBQ is a trading name of Firebug BV, enterprise number 0761.628.954, VAT number BE0761.628.954. Address and correspondence address: Van Eycklaan 11, 9990 Maldegem, Belgium. Email: info@elkedag-bbq.be. Telephone: +32 50 71 51 71. Website: https://elkedag-bbq.be.

Please use these contact details for questions about an order, return, warranty or complaint. Opening hours and collection arrangements are available on our website or in your appointment confirmation.

2 Scope and customer type

A consumer is a natural person acting for purposes outside their trade, business, craft or profession. A business customer acts for professional purposes. Providing an enterprise number alone does not deprive a customer of mandatory consumer rights where these apply by law.

The articles for consumers apply only to consumers. Special rules for business customers are set out in article 10. An individually and expressly agreed arrangement takes precedence over these terms, provided it does not conflict with mandatory law. Any specific workshop terms are communicated before booking.

3 Offers and conclusion of the contract

We describe the main characteristics, price and available delivery methods for our products and workshops before purchase. Images are illustrative but do not detract from the agreed characteristics. We do not replace an ordered product with a materially different product without your consent.

When ordering through the webshop, you can check and correct your details, products, quantities and total price before placing the order with an obligation to pay. The contract is concluded when we accept and confirm the order. A message expressly acknowledging only receipt of a request does not constitute acceptance. We provide confirmation with the applicable terms on a durable medium, for example by email with a PDF attachment.

A quotation is valid for the period stated in it. If no period is stated, it remains valid until lawfully withdrawn. The contract is concluded upon acceptance in accordance with the quotation. In the shop, the contract is concluded when we agree on the product and price.

In the event of an obvious error, we contact you as soon as possible. We do not unilaterally increase an agreed price. The consequences of an error are assessed under the applicable legal rules; this provision does not give us a general right to cancel orders arbitrarily.

4 Prices and payment

Prices are in euros, including VAT and other mandatory taxes. Any delivery charges and other agreed costs are clearly stated before purchase. No optional extras are added without your express choice.

The agreed total price applies to your order. Available payment methods are shown at checkout or in the quotation. Online orders are payable in advance unless otherwise agreed. Where we allow payment on invoice, the previously agreed period applies; unless otherwise agreed, this is 14 calendar days from the invoice date. The bank account number and payment reference appear on the invoice.

Our online payments are processed by Mollie through the payment procedure offered. The available payment methods are displayed at checkout.

To the extent permitted by law, delivered goods remain our property until payment in full.

5 Delivery and collection

We deliver to the agreed address within the delivery area available when ordering. We do not deliver outside the European Union. Collection is possible according to the option selected when ordering.

For consumers, the agreed delivery period applies. Unless otherwise agreed, we deliver without undue delay and within 30 days of concluding the contract at the latest. In the event of delay, you may give us an appropriate additional period. If we still fail to deliver, you may terminate the contract. An additional period is not necessary if we refuse delivery or if timely delivery was essential under the law. Upon termination, we refund the relevant amounts received without undue delay. Other statutory rights remain unaffected.

For consumers, we bear the risk of loss or damage until you, or a third party designated by you other than the carrier, physically receive the goods. If you choose a carrier that we did not offer, the statutory exception applies from handover to that carrier.

Check the shipment upon receipt where possible. Report damage or an incorrect product as soon as possible and include photographs. Refusing a damaged parcel may be useful, but accepting a parcel, failing to make a reservation or not reporting immediately does not extinguish your statutory rights. Keep packaging and proof of purchase where possible so that we can investigate the complaint.

6 Consumers' right of withdrawal

For a distance purchase or a purchase away from our business premises, you may in principle withdraw from the contract without giving a reason within 14 calendar days. For goods, the period starts on the day after receipt by you or your designated third party. For one order with separately delivered goods, receipt of the last good counts; for delivery in several parts, receipt of the last part counts. For regular delivery over a defined period, receipt of the first good counts. For services, the period starts on the day after concluding the contract. Exceptions are set out in article 7.

Before the period expires, you may send an unequivocal statement to info@elkedag-bbq.be or to Firebug BV, Van Eycklaan 11, 9990 Maldegem. The model withdrawal form can be downloaded separately from our website. Please preferably include your name and order number.

You may also use the ‘RETOUR’ function on our website. After entering your name, details allowing us to identify the order and your email address, submit the statement using ‘Herroeping bevestigen’ (Confirm withdrawal). We acknowledge receipt without delay by email, including the content, date and time of your statement.

Send or hand over the goods to Firebug BV — Elkedag-BBQ, Van Eycklaan 11, 9990 Maldegem, Belgium, within 14 calendar days of notifying us of withdrawal at the latest, unless we offer collection or agree another return address with you. You meet the deadline if you send the goods before that period expires. A purchase concluded entirely in the physical shop carries no general statutory right to return goods because you have changed your mind; any expressly offered commercial returns policy remains applicable.

For an ordinary withdrawal, you bear the direct return costs. For goods that cannot be returned by ordinary post, such as certain large BBQs, we communicate the return costs or a reasonable maximum estimate in advance. If this required information is missing, we bear those costs. For a justified warranty claim or incorrect delivery, we bear the necessary return costs.

In the event of full withdrawal, we refund all payments received, including the cost of our cheapest standard delivery option, within 14 days of becoming aware of your withdrawal at the latest. Extra costs for a more expensive delivery option chosen by you are not refunded. We may withhold reimbursement until we have received the goods or you provide proof of return, whichever occurs first, unless we have offered to collect them ourselves. We use the same payment method unless you expressly agree to another method without cost. We do not require you to accept a credit voucher.

Please return goods in their original packaging, although this is not an absolute condition for withdrawal. Opened packaging does not automatically exclude the right of withdrawal.

7 Exceptions and services

The right of withdrawal is excluded, among other cases, for goods made to your specifications or clearly personalised for you; goods liable to deteriorate or expire rapidly; and sealed goods unsuitable for return for health protection or hygiene reasons that you have unsealed after delivery.

Food, sauces and rubs are excluded from withdrawal because they are foodstuffs.

Events with a date or period specified in the contract, including a BBQ workshop on a specific date, are subject to the statutory exception to the right of withdrawal. An open gift voucher or booking without a fixed date does not automatically fall within that exception.

For other services beginning during the withdrawal period, we ask for your express request to start early. If you subsequently withdraw, you pay only the legally permitted proportionate amount for the service already provided.

8 Statutory guarantee and use

The statutory conformity guarantee applies to sales of goods to consumers. As seller, we are responsible for conformity defects that exist on delivery and become apparent within two years of delivery. A defect appearing within that period is presumed to have existed on delivery, subject to statutory proof to the contrary or incompatibility of that presumption with the nature of the goods or defect.

Report a defect as soon as possible and within two months of discovery using our contact details. You may demonstrate a purchase with an invoice, till receipt or other appropriate evidence.

You may request repair or replacement within a reasonable time and without significant inconvenience, subject to the statutory conditions concerning possibility and proportionality. There is no right to terminate for a minor defect. Statutory rules on suspension and any extension of the guarantee period remain applicable.

For goods with digital elements, statutory obligations concerning the relevant digital content or service and necessary updates also apply. Any commercial guarantee from us or a manufacturer supplements statutory protection and does not restrict it.

Use and maintain products in accordance with the instructions provided. Damage demonstrably resulting from misuse, an inappropriate modification or normal wear and tear is not, in itself, a conformity defect. Food is subject to the communicated storage and use instructions and applicable shelf life.

9 Late payment by consumers

We first send a free reminder. You then have at least 14 calendar days to pay without compensation or interest. For electronic reminders, that period starts on the next calendar day; for postal reminders, on the third working day after dispatch. The reminder states the debt, due date, our identity and enterprise number, the payment period and any compensation applicable afterwards. On request, we provide supporting documents and information to dispute the debt.

Only once that period expires without payment may we charge late-payment interest on the unpaid principal from the following day, at the rate then applicable under article 5, second paragraph, of the Law of 2 August 2002, never exceeding the maximum under Book XIX of the Belgian Code of Economic Law. We do not backdate interest to before the end of this waiting period.

In addition, a flat-rate compensation may apply once for the debt concerned: €20 for an outstanding balance up to €150; €30 plus 10% of the portion exceeding €150 for a balance up to €500; €65 plus 5% of the portion exceeding €500 for a higher balance, capped at €2,000. We add no other amicable reminder or recovery costs. Compensation must remain reasonable and legally permissible; a court may disapply an unfair term.

Reciprocity: if we fail to make a due refund to you on time, after a written demand and the same waiting period you are entitled to the same interest and flat-rate compensation on the overdue amount. For another attributable failure to perform by us, following an appropriate formal notice where required, you are entitled to equivalent flat-rate compensation under the scale above, calculated on the value of the unperformed part. Instead, you may claim compensation for your proven loss where the law allows, without double recovery for the same loss. Your other statutory remedies remain available.

10 Special rules for business customers

10.1 Ordering and professional use

A business customer provides correct company, invoicing and contact details and informs us of the intended professional use where this imposes special requirements on the product, for example intensive professional use. We expressly confirm any particular suitability agreed. This does not release us from our duty to provide information and deliver conforming goods. Anyone ordering on behalf of a company must have authority to do so; this provision does not create a personal guarantee.

Individual arrangements in an accepted quotation or order confirmation take precedence. Conflicting purchasing terms apply only insofar as they lawfully form part of the contract.

10.2 Price, invoicing and delivery

A business price excluding VAT is expressly stated as such. Transport, assembly and other additional services are charged only if agreed in advance. The payment period is stated in the contract; where invoice payment is allowed without another arrangement, article 4 applies. We invoice through the legally prescribed channel where mandatory. An administrative request does not automatically change the agreed due date, but does not prejudice statutory defences concerning a defective invoice.

We deliver at the agreed time and place. An estimate is identified as an estimate. Inform us beforehand if a particular delivery date is essential. For transport arranged by us, we also bear the risk for business customers until physical receipt at the agreed place. On collection, risk passes upon handover. A different arrangement requires express agreement. The retention of title in article 4 remains applicable within statutory limits.

10.3 Inspection, warranty and returns

Inspect the delivery within a reasonable time and report identified defects without undue delay, with a specific description and evidence where possible. Notify us of any invoice dispute, with reasons, as soon as possible. These terms introduce no automatic time bar for complaints and do not make silence conclusive acceptance. The undisputed part remains payable under the contract, without prejudice to any legally justified suspension.

The statutory consumer rules on withdrawal and the two-year conformity guarantee do not apply to professional purchases. Rights concerning non-conforming delivery, latent defects and expressly promised commercial guarantees remain unaffected.

A business return due to a change of mind or cancellation of a product order requires a previously agreed arrangement or our written consent. Any reasonable costs are agreed in advance. We do not apply an automatic restocking fee. Article 11 also applies to business bookings for BBQ workshops unless another valid arrangement has been expressly agreed. Statutory rights in the event of breach or force majeure remain unaffected.

10.4 Late payment and recovery

For commercial transactions within the scope of the Law of 2 August 2002, where the statutory conditions are met, statutory interest for late payment in commercial transactions is due automatically and without formal notice from the day after the due date. The statutory interest rate applicable at that time applies.

Where that interest is due, the statutory fixed compensation of €40 for recovery costs also applies. Only reasonable and demonstrable additional recovery costs exceeding that amount may be claimed under the law, without double recovery. This may include the costs of an appointed debt collection agency or lawyer; it does not automatically include all costs or an arbitrary percentage. Article 15 governs engaging a third party.

10.5 Suspension and termination

In the event of a sufficiently serious breach, the parties may exercise their statutory rights to suspend performance or terminate, with prior formal notice and a reasonable remedy period where required. The measure must be proportionate to the breach. The liability provisions in article 12 also apply to business customers. Mandatory protection against unfair terms between businesses remains fully applicable.

11 BBQ workshops

The booking description states the date, start time, location, duration, price, included services and any participation conditions. The booking becomes definitive in accordance with the communicated confirmation and payment terms. Article 7 applies to workshops on a specific date. Our workshops take place outdoors under a spacious stretch tent. Normal weather conditions do not, in themselves, justify cancelling a workshop.

Report cancellation or a request to substitute a participant as soon as possible to info@elkedag-bbq.be. The period is calculated by comparing the time we receive your cancellation with the scheduled start time. The arrangement is: at least one calendar month beforehand, a 100% refund; less than one calendar month but more than seven calendar days beforehand, a 90% refund; seven calendar days or less beforehand, no refund. The corresponding cancellation fee is therefore 0%, 10% or 100% of the participation price.

This fee covers our reasonable costs and loss resulting from the cancellation and must not be disproportionate. We take account of saved costs and proceeds from reselling your place, so that the same loss is not compensated twice. You may demonstrate that the actual loss is lower; in that case we adjust the fee. We confirm the amount to be refunded by email. A refund follows within 14 calendar days of determining the amount.

A workshop takes place with at least eight participants. If that minimum is not reached, we may cancel the workshop or propose another date. We inform you as soon as this becomes clear, before the scheduled start time.

In exceptional weather conditions making safe performance impossible, or other statutory force majeure, a workshop may be postponed or exceptionally cancelled. We inform you as soon as possible. Ordinary rain or disappointing weather under the stretch tent does not automatically constitute force majeure.

If we cancel or reschedule and you do not accept the change, you may choose an offered new date or a full refund of the price paid for the workshop not provided. We refund within 14 calendar days of your choice of a refund. The cancellation percentage for cancellation by the customer does not apply in these cases. We do not impose a credit voucher or new date. For another material change that you do not accept, you receive a refund of the price paid for the part concerned. In the event of an attributable breach, statutory rights and article 9 remain applicable.

Participants follow reasonable safety and hygiene instructions. Report relevant allergies in good time so that we can discuss what is possible; we provide the legally required allergen information. We do not promise an allergen-free environment without express confirmation. Images may be taken during participation in the workshop for commercial purposes; if you do not wish to appear in images, please make this known beforehand.

12 Liability and force majeure

Our liability is determined by applicable law.

Statutory rules apply to force majeure. The affected party informs the other as soon as possible and limits the consequences where reasonably possible. A problem with a supplier, carrier or payment service does not automatically constitute force majeure. In the event of definitive impossibility, amounts for services or goods not provided are refunded under the statutory rules. In the event of temporary impossibility, applicable rights to performance or termination remain; there is no unlimited suspension.

13 Personal data and complaints

Firebug BV processes personal data for purposes including orders, payments, delivery, services and legal obligations. Where necessary, data is shared with relevant service providers, such as payment and transport partners. The privacy notice on our website describes purposes, legal bases, recipients, retention periods and your rights. Acceptance of these terms does not, in itself, constitute consent to non-essential cookies or marketing.

You may send a complaint to info@elkedag-bbq.be or our correspondence address, preferably stating your order number and the desired solution. We investigate the complaint and respond within a reasonable time.

If a solution cannot be reached, as a consumer you may contact the Consumer Mediation Service (Consumentenombudsdienst), Koning Albert II-laan 8 bus 1, 1000 Brussels, contact@consumentenombudsdienst.be, https://consumentenombudsdienst.be. This service deals with cases within its remit or refers them to the competent body. You retain the right to bring proceedings before the competent court.

14 Applicable law and version

Belgian law applies. This choice of law does not deprive a consumer of mandatory protection under the law of their habitual residence where that protection applies under the relevant international rules. The courts designated by law remain competent.

An invalid or unfair provision is disapplied. The rest of the contract remains effective insofar as it can continue without that provision.

The version applicable when the contract is concluded is retained with the order or confirmation. This text replaces earlier versions only for new contracts for which it was made available and accepted beforehand.

15 Engaging a debt collection agency

For unpaid debts that are due, we may engage a debt collection agency, lawyer or bailiff. For consumers, we first observe the free reminder and waiting period in article 9. For amicable recovery of consumer debts, we engage a debt collection agency registered for that purpose with the Belgian FPS Economy, or a professional legally exempt from that registration.

For consumers, the debt collector checks the amounts claimed and sends the legally required formal notice. A new period of at least 14 calendar days then applies, during which no other amicable recovery actions may take place. The consumer may request evidence, dispute the debt with reasons and request payment arrangements. Statutory suspensions and protective rules remain applicable.

We share only the data necessary to investigate and recover the debt, such as identity, contact details, contract, invoice, payments and relevant correspondence, on an appropriate legal basis. We communicate payments and disputes promptly. You may always contact us and the case handler identified in the formal notice.
